License Agreement for the Use of the Computer-based Pastoral Resource Assessment Model, RAPS ============================================================ The suite of software that comprise the pastoral resource assessment model known as RAPS(“the Programme”) is designed, coded and owned by Peter S. Harris (“the Owner”). The Programme is copyrighted material. Upon full payment of a license fee (Evaluation versions refer to Note 1 and Base versions refer to Note 2) to the Owner, a Single User License (Multi-User Licenses are available) is granted to use the Programme according to the following conditions. The Licensee may: - Use a single copy of the Programme. - Use the Programme on any computer for which it was designed. - Make copies of the Programme for personal backup purposes within the Licensee's own enterprise or institution. The Licensee may not: - Modify the Programme and merge it into another programme. - Sub-license, share, loan, rent, lease, or assign the Programme (Note 3) - Reverse assemble, reverse compile, or otherwise translate the Programme. - Install the Programme on a network. The RAPS programmes and any dynamically linked files (other than those which are of Third Party origin), help files, documentation, configuration files, graphics files and all other related files remain the property of the Owner. The Programme is licensed “as is” without warranty as to its performance or suitability for a particular purpose. The entire risk as to the Programme's quality and performance is assumed by the Licensee. Therefore the Owner will not be liable for any of the following: - Third-party claims for losses or damage. - Loss of, or damage to, records or data. - Economic consequential damages (including lost profits or savings) or incidental damages. At the Owner’s discretion, reasonable provision will be made for the transfer of the licensed Programme if and when the Licensee’s computer is updated or replaced. Any exceptions to the terms of the license must be mutually agreed, in writing, by the Owner and the Licensee. ============================================================ Note 1: “Evaluation” copies of the Professional version of RAPS are not subject to the license fee, but subject to all other conditions of the License Agreement. Evaluation copies may only be used for up to 28 days from date of installation of the Programme. Note 2: “Base” versions of RAPS are not subject to the license fee, but subject to all other conditions of the License Agreement. “Base” copies are without time restriction. Note 3: Both fully licensed and evaluation copies of RAPS can only be obtained directly from the Owner or the official web site.
